Terms of Business

These Terms of Business govern the relationship between Morven Energy Consulting and any business client engaging our services. By requesting a quotation or otherwise engaging with us in connection with your energy procurement, you confirm acceptance of these Terms.
1. Our Services
1.1We obtain energy quotations from a panel of suppliers on your behalf, using consumption and site data you provide.
1.2We present quotations clearly and impartially. We do not favour any particular supplier.
1.3We manage the contract placement process once you have confirmed your decision in writing.
1.4We provide ongoing contract management support including renewal reminders and supplier liaison.
1.5Our services are available for electricity, gas, and other utility contracts as agreed.
2. Commission Disclosure
2.1Our services are provided to you at no direct cost. We earn commission from the energy supplier, embedded within the unit rate of your contract.
2.2In compliance with Ofgem requirements effective from 1 October 2024, we will provide written confirmation of our commission in pence per kilowatt-hour before you sign any contract.
2.3Typical commission rates range from 0.5p to 3p per kWh. Your specific figure will be confirmed prior to signature.
2.4You may request full commission disclosure at any time. We will respond within five working days.
3. Your Obligations
3.1You must provide accurate consumption data and site information. We accept no liability for inaccurate quotations arising from incorrect information provided by you.
3.2You must not approach any supplier directly following receipt of a quotation from us without first notifying us in writing. See Section 6.
3.3Where you operate multiple sites, you must disclose all relevant sites at the outset of engagement.
4. Contract Placement
4.1Business energy contracts are not subject to a statutory cooling off period. Once signed and accepted by the supplier, the contract is legally binding.
4.2Early termination may incur exit fees levied by the supplier. We will advise you of these before placement. We accept no liability for early exit fees arising from your decision to terminate.
5. Circumvention
5.1Where we have introduced you to a supplier or presented a quotation, you agree not to enter into a direct contract with that supplier for the same supply period without our written consent.
5.2If you circumvent our introduction, you agree to pay a fee equivalent to the commission we would have earned, calculated at our standard rate applied to your estimated annual consumption for the contract term.
5.3This protection applies for twelve months from the date we first approached a supplier on your behalf.
6. Renewal
6.1Where we have placed a contract on your behalf, we retain the right to be given the first opportunity to requote at renewal. We will contact you no less than six months before your contract end date.
6.2You remain free to seek alternative arrangements if you choose not to proceed with our renewal quotation.
7. Data Protection
7.1We handle all data in accordance with the UK GDPR and the Data Protection Act 2018.
7.2We share your data with energy suppliers solely for the purpose of obtaining quotations and placing contracts. We will never sell your data to third parties.

8. Liability & General
8.1We act as an intermediary only and are not responsible for the performance or service levels of any energy supplier.
8.2Our liability shall not exceed the total commission earned from your account in the twelve months preceding any claim.
8.3Complaints should be directed to jordan@morvenenergy.com. We will acknowledge within five working days.
8.4These Terms are governed by the laws of England and Wales.
Acceptance
By requesting a quotation, asking for information about our services, or otherwise engaging with Morven Energy Consulting in connection with your energy procurement, you confirm that you have read and understood these Terms and agree to be bound by them. These Terms are available at morvenenergy.com and will be provided directly upon request.
